Terms of Service

1. About Scenisk

Scenisk is an online marketplace that connects clients seeking live music for private events with independent professional musicians and performers. Scenisk is not a talent agency, employer, or party to any agreement between a client and an artist. All bookings are contracts entered into directly between the client and the artist.

By creating an account or using the platform, you agree to these Terms of Service. If you do not agree, please do not use Scenisk.

2. Eligibility

You must be at least 18 years old to use Scenisk. By registering, you confirm that the information you provide is accurate and that you have the legal capacity to enter into binding agreements.

3. Artist accounts

Artists on Scenisk are independent contractors, not employees or agents of Scenisk. Artists are solely responsible for the accuracy of their profile, the quality of their services, their availability, and their compliance with applicable laws including tax obligations.

Scenisk reserves the right to verify artist profiles and suspend or remove any account that contains false, misleading, or inappropriate content.

Artists retain full ownership of the content they upload (photos, biography, media links). By publishing this content on Scenisk, artists grant Scenisk a non-exclusive, royalty-free license to display it on the platform for the purpose of facilitating bookings.

4. Booking requests

A booking request submitted by a client is an offer to engage an artist under the terms specified. The booking is not confirmed until the artist explicitly accepts the request. Scenisk facilitates this exchange but does not guarantee acceptance by the artist.

Once an artist accepts a booking, both parties are bound by the agreed terms including the event date, venue, package, and price.

5. Cancellation policy

  • While pending: A client may cancel a booking request at no charge at any time before the artist accepts it. Full refund applies when payment is processed.
  • After confirmation: Once an artist has accepted a booking, cancellation by the client results in forfeiture of 50% of the total booking amount as a deposit. The remaining 50% is refunded.
  • Artist cancellation: If an artist cancels a confirmed booking, the client is entitled to a full refund. Scenisk reserves the right to suspend artists who cancel confirmed bookings without valid cause.

6. Platform fees

Scenisk charges a service fee on transactions processed through the platform. The applicable fee rate will be clearly disclosed at the time of booking. Fee structures are subject to change with reasonable notice to users.

Note: payment processing via Stripe is not yet active. This clause will apply upon launch of the payment feature.

7. Prohibited conduct

Users of Scenisk may not:

  • Circumvent the platform to arrange bookings directly and avoid platform fees
  • Provide false information in any profile, booking request, or review
  • Harass, threaten, or engage in discriminatory conduct toward other users
  • Use the platform for any unlawful purpose
  • Attempt to access, scrape, or reverse-engineer any part of the platform

Violation of these terms may result in immediate account suspension without notice.

8. Reviews

Clients may submit reviews following a completed booking. Reviews must be honest and based on direct experience. Scenisk reserves the right to remove reviews that are fraudulent, abusive, or in violation of these terms. Artists may not solicit, incentivize, or manipulate reviews.

9. Limitation of liability

Scenisk is a technology platform and is not responsible for the conduct, performance, or reliability of any artist listed on the platform. Scenisk does not guarantee the outcome of any event, the quality of any performance, or the accuracy of any artist profile beyond reasonable verification efforts.

To the fullest extent permitted by applicable law, Scenisk's total liability to any user in connection with the platform shall not exceed the amount paid by that user to Scenisk in the twelve months preceding the claim.

10. Governing law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these terms or your use of Scenisk shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

Note: governing jurisdiction will be updated to reflect the Dubai International Financial Centre (DIFC) upon incorporation of the operating entity in the UAE.

11. Changes to these terms

Scenisk reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to this page with an updated date. Continued use of the platform following any modification constitutes acceptance of the revised terms.
